Supreme Court to rule on FDA's restriction on celebrity endorsements of alcoholic beverages today

The decision is the result of a court struggle involving Ghanaian celebrities and the Food and Drugs Authority (FDA), the nation's regulatory agency.

The main players in this legal battle include Mark Darlington, the former manager of hip-hop artists Skrewfaze and Reggie 'N' Bollie, as well as Mark Darlington Osae, who led the legal challenge against the FDA's prohibition on celebrity endorsements for alcoholic beverages.

In his social media post, Darlington wrote, "SUPREME COURT JUDGEMENT IS TODAY!! Just to alert you that the FDA Celebrity Ban Court judgment will be given TODAY, Wednesday, 8th May 2024, at the SUPREME COURT premises, Accra. Time: 9.30 am Sharp! Thnx."

On the other hand, the creative industry is opposing this approach.

The FDA and Attorney General Godfred Yeboah Dame were sued in November by Mark Darlington Osae, the manager of Reggie 'N' Bollie and Skrewfaze, who was protesting the prohibition.

Many interested parties have voiced their opposition to the law and called for its repeal, including Camidoh, Brother Sammy, Kuami Eugene, Wendy Shay, and Shatta Wale.

Osae filed a writ of summons on November 11, 2022, claiming that the FDA's 2015 regulations unfairly target the creative arts business. Osae is also a music publisher at Perfect Note Publishing.
